Device as a Service (DaaS) Terms & Conditions

This agreement covers the rental of VoIP phone hardware provided by BayFront Cloud LLC as part of our Device as a Service (DaaS) program.

Phones are rented, not purchased
Billed monthly on your recurring invoice

Equipment & Ownership

What's included:

  • • VoIP desk phones, conference phones, or cordless handsets as specified in your quote
  • • Power adapters, Ethernet cables, and mounting hardware where applicable
  • • Initial configuration and provisioning on your phone system

Ownership Notice

All rented phone hardware remains the sole property of BayFront Cloud LLC at all times. This is a rental arrangement — no ownership rights transfer to the customer at any point during or after the rental period.

Billing & Payment

Monthly Rental Fee

Phone rental is billed monthly as a recurring line item on your invoice. The per-device rental rate is specified in your service quote or agreement.

Rate Changes

Rental pricing may be adjusted with a minimum of 30 days written notice. You may return devices and cancel the rental at that time if you do not accept the new rate.

Care & Responsibility

While the equipment is in your possession, you are responsible for its care and safekeeping.

Your Responsibilities

  • • Keep devices in a clean, dry environment
  • • Use equipment only for its intended purpose
  • • Do not open, modify, or attempt to repair devices
  • • Report any issues promptly to our support team
  • • Protect devices from power surges (use surge protectors)

We Handle

  • • Firmware updates and security patches
  • • Configuration changes and feature setup
  • • Replacement of devices with manufacturer defects
  • • Normal wear and tear over time
  • • Technical support and troubleshooting

Damage, Loss & Replacement

Customer is liable for:

• Accidental damage (drops, spills, impact)
• Theft or loss of equipment
• Damage from misuse or negligence
• Unauthorized modifications or repairs
• Damage from power surges (if no surge protector used)
• Unreturned equipment upon service cancellation

Replacement Fees

If a device is damaged beyond repair, lost, stolen, or not returned, a replacement fee will be assessed based on the current market value of the device model. BayFront Cloud will provide the specific replacement cost at the time of the incident.

Returns & Cancellation

Returning Equipment

  • • Devices must be returned in working condition
  • • All accessories (power adapters, cables) must be included
  • • Equipment must be factory reset before return (we can assist)
  • • Returns can be shipped or dropped off at our office
  • • Devices must be returned within 14 days of service cancellation

Cancellation

  • • Phone rental can be cancelled with 30 days written notice
  • • Final rental charges apply through the end of the billing period
  • • Unreturned devices after 14 days will incur replacement fees
  • • Early termination fees may apply if part of a bundled agreement

Additional Terms

General

This Phone Rental Agreement is supplemental to your Terms of Service and Service Agreement with BayFront Cloud LLC. In the event of a conflict, the more specific terms of this agreement shall prevail regarding phone hardware rentals.
